Preliminary version under legal review. Details in brackets will be completed before the commercial launch. The Spanish version prevails.
EdgeFinder Sports Terms and Conditions of Use
Version: 1.0 (draft) · Effective from: [PUBLICATION DATE]
1. Who we are and how to contact us
EdgeFinder Sports (the "Service"), available at app.edgefindersports.app in Spanish (/es) and English (/en), is provided by [COMPANY NAME], taxpayer ID (RUC) [RUC], with registered address at [REGISTERED ADDRESS], Ecuador ("EdgeFinder", "we", "us").
- Contact and support email: [CONTACT EMAIL]
- Privacy and data protection email: hola@edgefindersports.app
- Phone: [PHONE]
These Terms and Conditions (the "Terms") are a contract between you (the "User") and EdgeFinder. They govern your use of the website, accounts, free and paid plans, the artificial intelligence assistant and any other feature of the Service. The Spanish version of these Terms prevails over any translation.
2. What EdgeFinder is and is not
2.1. EdgeFinder is a sports statistics research tool. It collects team and player statistics for more than 50 competitions (for example LigaPro Ecuador, Copa Libertadores, European leagues, NFL, NBA, MLB, NHL, UFC, tennis and Formula 1). With them it calculates, using statistical models documented on the Methodology page:
- estimated probabilities of results and statistical markets (goals, corners, cards, shots, points, etc.);
- fair odds, meaning the inverse of the estimated probability;
- expected value (EV) and reliability of each estimate, always shown separately;
- where available, prices published by third-party sportsbooks, as a comparative reference only.
2.2. EdgeFinder is NOT a sportsbook or a sports betting operator. It does not take bets, deposits or balances, does not pay prizes, does not place bets on the User's behalf, does not act as an intermediary for any sportsbook and receives no commission on Users' bets. The subscription price is fixed and does not depend on any sporting result.
2.3. Not financial advice and not a guarantee. A probability is an estimate with a margin of error, not a promise: an outcome with a 70% probability fails, on average, three times out of ten. A positive modelled expected value does not guarantee profit. The User alone decides whether, where and how much to bet, and is responsible for that decision.
2.4. Third-party prices. Sportsbook prices come from data providers and may be delayed, incomplete or wrong. Before any decision, the User must check them directly with the operator. Showing a price is not a recommendation or endorsement of, and does not imply any commercial relationship with, that sportsbook. Users in Ecuador will only be shown prices from operators holding a valid Ecuadorian licence, or an unbranded market price. This last sentence depends on the advertising opinion (review §3) and on an official list of licensees being available.
3. Requirements to use the Service
3.1. Legal age. The Service is only for people aged 18 or over. By registering you confirm you are at least 18. If we detect that a User is a minor, we will close the account and delete their data, except data we must keep by law.
3.2. Law of your location. The Service is aimed at users in Ecuador. If you access it from another country, you are responsible for complying with its laws, including minimum betting ages (for example, 21 in most US states). Do not use the Service where betting information is prohibited.
3.3. Responsible gambling. If betting causes you problems, stop and seek help (see Responsible gambling). Under "My account > Responsible gambling" you can turn on self-exclusion, which hides odds, expected value, the scanner and the assistant for the period you choose.
4. User account
4.1. Some features require an account with an email address and password. You agree to provide true, up-to-date information, not to share your account and to keep your password secret. Tell us immediately at [CONTACT EMAIL] if you suspect unauthorised use.
4.2. Each person may hold only one account. Accounts are personal and non-transferable.
4.3. We use a CAPTCHA and usage limits to protect the Service from abuse and automated access.
4.4. You can delete your account at any time under "My account > Privacy". Deleting the account does not automatically refund payments already made. If you have an active subscription, cancel it first (section 6) or we will cancel it when you delete the account.
5. Plans and prices
5.1. Plans. EdgeFinder offers a Free plan and paid plans. The Pricing page details each plan's features, limits (including AI assistant credits), price and billing period. All plans cover every available league and sport; they differ by features, not by leagues. Each league's coverage depends on the data our providers deliver, and we do not show statistics we do not have. As of [DATE], the paid plans are:
| Plan | Price (VAT included) | Type |
|---|---|---|
| Pro monthly | USD 4.99 per month | Auto-renewing subscription |
| Pro annual | USD 39.99 per year | Auto-renewing subscription |
| Pro 30 days (prepaid) | USD 4.99 for 30 days | One-off payment, no renewal |
| Pro Season Pass (6 months) | USD 24.99 | One-off payment, no renewal |
| Analyst monthly | USD 9.99 per month | Auto-renewing subscription |
| Analyst annual | USD 79.99 per year | Auto-renewing subscription |
| Creator / Media (B2B) | Per contract | B2B contract |
5.2. Prices include VAT. All prices are in United States dollars (USD) and include Ecuadorian VAT (IVA, 15%) and any other applicable tax. You will see the final price and its breakdown before paying (e.g., USD 4.99 = USD 4.34 + VAT USD 0.65).
5.3. Promotions and founder pricing. Every promotion will state its duration or number of places, the regular price and the promotional price. If a promotion offers a founder price that is "locked", that price will apply at each renewal for as long as the subscription stays active without interruption. If you cancel or it lapses for non-payment, the founder price is lost. For other promotions, the current regular price applies when they end, and we will tell you before renewal.
5.4. Free Pro trial. We may offer a free 7-day trial of the Pro plan, once per person, with no card required. To prevent abuse, the trial requires a verified email and may use technical device signals (see the Privacy Policy). It is not offered to anyone who already had a paid subscription. Nothing is charged when the trial ends: your account automatically returns to the Free plan. The Analyst plan has no free trial.
5.5. Plan changes.
- Upgrades (e.g., Pro monthly to Analyst monthly) apply immediately, and only the difference for the remaining days of the cycle is charged. Differences under USD 1.00 are not charged.
- Monthly to annual applies immediately: the unused part of the paid month is credited and a new annual cycle starts.
- Downgrades (Analyst to Pro, annual to monthly, or paid to Free) apply at the end of the paid period, with no extra charge. You keep your current features until then.
- Prepaid pass to subscription applies by default when the pass expires. If you choose to activate it immediately, the unused days of the pass are credited.
- Purchases of USD 50 or more require your identification data for the invoice (section 6.7).
5.6. Price changes. If we change the price of your plan, we will email you at least 30 days before your next renewal. The new price will only apply if you expressly accept it. If you do not, your subscription will not renew and will end at the close of the paid period, with no further charge.
6. Subscriptions, automatic renewal, cancellation and refunds
6.1. Purchase. Subscriptions are bought online at checkout, where you will see the plan, the final price including VAT, the billing period, the first charge date and the renewal date. To subscribe you must tick acceptance of these Terms and of automatic renewal and press the payment button. After payment we will immediately email you, and in any case within the legal term of three (3) days, the purchased conditions, the version of these Terms you accepted and your invoice.
6.2. Automatic renewal. Monthly and annual subscriptions renew automatically for equal periods at the current accepted price, charged to the same card, until you cancel. We will email you at least 15 days before every renewal, monthly or annual, with the amount, the date and a direct cancellation link. For annual plans we will also remind you 30 and 7 days before. Prepaid passes (Pro 30 days and Season Pass) do not renew: when they expire, your account returns to the Free plan. We may remind you of the expiry by email and, if you agreed, by WhatsApp.
6.3. Cancel at any time. You can cancel at any time and without penalty under "My account > Subscription > Cancel subscription", the same online channel you used to subscribe, in no more than two clicks. We will not ask you to call or visit any office. Cancelling stops the next renewal, and you keep paid access until the end of the period already paid. Until then you can reactivate at no cost. We will email you a confirmation. Cancelling less than 15 days before renewal still prevents the next charge. Art. 44 of the Consumer Protection Law allows requiring 15 days' notice; we propose not requiring it, which is more favourable to the consumer.
6.4. Right of return (15 days). Under article 45 of Ecuador's Organic Consumer Protection Law, you may exercise your right of return within a term of fifteen (15) days following:
- the first purchase of any paid plan (monthly, annual, Pro 30 days or Season Pass), with a full refund of the amount paid and no reason required;
- the annual renewal charge, with a full refund.
Monthly renewals are not refunded: you can cancel at any time and there will be no further charges (section 6.3). The finance document proposed 7 days; this was extended to 15 because the amended art. 45 (Official Register, 11-Feb-2022) requires it. Confirm whether art. 45 also applies to each monthly renewal ("receipt of the service"). If it does, the right must be extended to monthly renewals.
To exercise this right, use the "Request refund" button under "My account > Subscription" or write to [CONTACT EMAIL]. Your paid access ends immediately (termination of the contract), and we will refund the amount to the same payment method within [10] days. Crediting times at your bank or card issuer are outside our control. We do not give internal balance, coupons or substitute services instead of money. For tax purposes we will issue the SRI electronic credit note that fully or partially cancels the invoice. That document is for tax purposes only and does not replace the refund.
6.5. Other refunds.
- Billing errors (duplicate charge or technical failure): immediate full refund.
- Annual plans after the return period: not refunded, except: (a) where the law requires it; (b) where the Service was not provided for reasons attributable to us; or (c) where we close the Service or your plan (section 13.3). In those cases we refund the unused pro rata amount. Apart from those cases, we may give a goodwill pro rata refund, at most once per customer per year.
- Downgrades do not trigger a refund: the change applies at the end of the paid period (section 5.5).
6.6. Payments, failed charges and chargebacks. Card payments are processed by [Kushki / PAYMENT PROVIDER]. One-off payments may also be processed by [Payphone]. EdgeFinder does not store full card numbers. If a renewal charge is declined:
- we will tell you by email and on the site, and you keep access for a 7-day grace period;
- we will retry the charge on days 1, 3 and 5, and you can update your card at any time;
- if payment has not succeeded after 7 days, we will cancel the subscription, your account will move to the Free plan and we will not charge you for the unpaid period. Your saved searches will be kept for 90 days.
We charge no fee for failed payments. If you file a chargeback with your bank, we will suspend paid features while it is resolved. Please write to us first: we can almost always fix it with a refund.
6.7. Electronic invoicing. We issue electronic tax documents authorised by Ecuador's tax authority (SRI). For this we will ask for your ID type and number (cédula, RUC or passport), your full name or company name, your address and an email address. For purchases under USD 50 you may choose "final consumer". Above that amount, the rules require you to identify yourself. You are responsible for the accuracy of your billing data; incorrect data may prevent us from issuing the invoice in your name. Invoices are available under "My account > Invoices" and are emailed to you.
7. Artificial intelligence assistant (EdgeFinder AI)
7.1. It is an AI, not a person. EdgeFinder AI is an automated assistant based on a language model from an external provider (currently Anthropic, PBC, United States). At the start of each conversation we tell you that you are talking to an artificial intelligence.
7.2. What it does. It answers questions about matches, statistics and markets using only the numbers from EdgeFinder's statistical engine. On request, it indicates the selection with the highest modelled expected value and combinations of selections, always with their probability, fair odds, reliability and a link to the evidence.
7.3. Limitations. The assistant can make mistakes, misread a question, miss information (for example last-minute line-ups or injuries) or phrase things imprecisely. Its answers are not financial advice or a personalised investment recommendation and do not guarantee any result. Probabilities of same-game combinations are approximate because outcomes are correlated, and a combination always has a lower probability than each of its legs. Check the linked evidence before any decision.
7.4. Permitted use. Do not try to make the assistant produce illegal, misleading or harmful content, bypass its safeguards, or let a minor use it. Do not include personal data (yours or anyone else's) in your messages. Your message text is sent to the AI provider to generate the answer (see the Privacy Policy).
7.5. Usage limits. We may limit the number of queries per user or IP address to keep the Service available.
8. Acceptable use
When using the Service you agree not to:
- extract data automatically (scraping, crawling, bots, spiders), except through an API we have enabled for you in writing and within its limits;
- resell, redistribute, sublicense, mass-publish or commercially exploit the probabilities, odds, statistics, texts or any content of the Service, including in paid "picks" groups on Telegram, WhatsApp or other platforms, without a signed B2B contract with us;
- share your account or credentials, or create several accounts to get around limits or promotions;
- bypass technical measures such as the CAPTCHA, usage limits or access controls on paid features;
- reverse-engineer the models or software, except as expressly permitted by law;
- present EdgeFinder content as your own, alter its results or screenshots, or impersonate EdgeFinder (for example, fake "VIP EdgeFinder" groups);
- use the Service if you are under 18 or the law prohibits it;
- use the Service for unlawful purposes, including match-fixing or the use of inside information;
- introduce viruses or malicious code, or attack or overload the infrastructure.
Personal quotation: you may share screenshots or individual figures on social media to discuss a match, citing "Source: EdgeFinder Sports", for non-commercial purposes.
9. Intellectual property
9.1. Our content. The software, models, computed probabilities, texts, methodology, design, and the "EdgeFinder Sports" name and logo belong to [COMPANY NAME] or its licensors and are protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service according to your plan and these Terms.
9.2. Third-party data. Sports statistics and prices come from data providers with their own licence terms. Those terms may limit what we display and what you may do with that data.
9.3. Third-party marks. Names of teams, leagues, competitions, players and sportsbooks are trademarks or signs of their owners. We use them only to identify them, which does not imply affiliation, sponsorship or endorsement.
9.4. Your input. If you send us suggestions or feedback, we may use them to improve the Service without any obligation to compensate you. Your saved searches and bet records are yours, and you can download or delete them.
10. Availability and changes to the Service
10.1. We make reasonable efforts to keep the Service available and the data up to date, but there may be interruptions for maintenance, data-provider failures or causes beyond our control. If a section is still being computed, the page will say so ("Updating data…").
10.2. We may improve or modify features. If a change substantially reduces the features of a paid plan you hold, we will notify you in advance and you may cancel with a refund of the unused pro rata amount.
11. Liability
11.1. User decisions. EdgeFinder provides statistical information. We are not responsible for the losses or winnings of bets you choose to place with third parties, or for decisions you make based on the Service, because the decision to bet, the operator chosen and the amount are yours.
11.2. Accuracy. We take care over the quality of data and models and publish their calibration, but we do not guarantee that third-party data is error-free or that sporting results will follow the estimated probabilities.
11.3. Consumer rights. Nothing in these Terms limits or excludes the rights granted to you by Ecuador's Organic Consumer Protection Law, or our liability for defects in the Service you purchased, as mandatorily provided by law. If the paid Service is not provided as offered for reasons attributable to us, you may request correction, proper performance or a refund for the affected period, in addition to your other legal rights. Art. 43.1 of the Consumer Protection Law voids clauses that limit liability for service defects; no liability cap is therefore included. Consider whether a cap is possible for B2B users.
12. Suspension for breach
We may suspend or close your account if you breach these Terms, especially sections 3 (age) or 8 (acceptable use), or if the law or an authority requires it. Except in urgent cases (security, fraud, a minor, or an authority's order), we will notify you first and give you a chance to explain. If we close a paid account for a serious, proven breach, we will not refund the current period, unless the law provides otherwise.
13. Term and termination
13.1. These Terms apply while you use the Service.
13.2. You may stop using the Service, cancel your subscription or delete your account at any time.
13.3. If we decide to discontinue the Service or a plan, we will give at least 30 days' notice and refund the unused pro rata part of paid periods.
14. Electronic communications
14.1. You agree to receive by email and in your account the communications necessary for the contract: confirmations, invoices, renewal notices, changes to the Terms and security notices. To access them you need an up-to-date web browser and a PDF reader. You may request a paper copy of your contractual documents at [CONTACT EMAIL], free of charge. If you withdraw your consent to electronic communications, we cannot continue providing the paid Service, which is entirely online, and you may cancel it without penalty.
14.2. Marketing communications (news and offers) are sent only if you accept them separately, and you can unsubscribe at any time using the link in each email or under "My account".
15. Changes to these Terms
We may update these Terms to reflect legal, security or Service changes. We will publish the new version with its effective date and, if the change materially affects your rights or obligations, email you at least 15 days in advance. Changes affecting a purchased paid plan (price, essential features or renewal conditions) apply only from your next renewal and only if you expressly accept them. If you do not accept them, your subscription ends at the close of the paid period. We keep previous versions, including the one you accepted.
16. Complaints
If you have a problem, write to [CONTACT EMAIL]. We will reply within [10] business days. You may also file a complaint with Ecuador's Defensoría del Pueblo (Ombudsman) and, for personal data matters, with the Superintendencia de Protección de Datos Personales. Confirm the competent consumer authority and current complaint channel.
17. Governing law and jurisdiction
17.1. These Terms are governed by the laws of the Republic of Ecuador, in particular the Organic Consumer Protection Law, the Electronic Commerce, Electronic Signatures and Data Messages Law, and the Organic Personal Data Protection Law.
17.2. Any dispute with a consumer User will be submitted to the competent courts of the consumer's domicile in Ecuador, under article 47 of the Electronic Commerce Law. The parties may voluntarily use mediation. No mandatory arbitration is imposed.
17.3. For B2B Users (companies buying Creator/Media plans), the parties may agree on a different jurisdiction or arbitration in their contract.
18. Final provisions
18.1. If any clause is declared void, the rest of the Terms remains in force.
18.2. Failing to exercise a right is not a waiver of it.
18.3. You may not assign this contract without our consent. We may assign it in a reorganisation or sale of the business, with prior notice and preserving your rights.
18.4. These Terms, the Privacy Policy, the Cookie Policy and the plan conditions shown at checkout make up the entire agreement between you and EdgeFinder.
18+ (21+ in most US states). EdgeFinder is not a sportsbook and does not take bets. Betting involves the risk of losing money. No model guarantees results.
